Terms of use · with the guarantee section
Nothing is sold on this site, and these terms say exactly what we will stand behind.
These are the Xavriqon terms of use for xavriqon.com, in thirteen numbered sections. Section 09 is the guarantee: short, because a small office that promises little can keep all of it.
Who these terms are with
You are dealing with Xavriqon, trading at xavriqon.com, 152 Oak Lane, Suite 4, Austin, Texas 33038, United States. "We" and "the office" mean Xavriqon. "You" means whoever is reading the site or sending us a letter through it.
Using the site means you accept these terms. If you do not, close the tab. Nothing breaks and nobody is told.
What the site does, and what it does not
xavriqon.com is a held domain with a short list of directions. It publishes those directions with a status each: naming and rare-domain consultation is Open; field notes and small tools are In study; research and archive is Parked; Austin partnerships is Listening. It also offers a fit checker that routes a letter, and forms that send a written inquiry.
It does not sell anything, does not take payment, does not open accounts and does not run a mailing list. It does not sell the domain xavriqon.com and does not broker other names. A direction marked In study, Parked or Listening is a statement of where the work stands, not an offer and not a promise that it will ever launch.
Every contact is an inquiry, never an order
There is no cart and no checkout here. Sending a form or a chat message creates no contract and commits neither side to anything. Any figure that appears in a reply, a call or a document before a signed engagement is an estimate and not a binding quote.
For the one open direction, the path is this:
- You write through the contact form or by email, saying what the name is for.
- We reply, usually within three business days, and offer one call if the work fits.
- After the call we send a written scope with a fee in US dollars.
- Work starts only after you accept that scope in writing. The written scope then governs the job, and where it conflicts with these terms, the scope wins.
Fees, currency and what moves a price
No price is published on this site. A naming assessment is priced per job, in US dollars, after one call. What sets the fee: how many candidate names you want tested, whether you need a rare-domain availability check across extensions, and how soon you need the written answer. A shorter deadline costs more, because it pushes other letters back.
A quoted fee holds for 30 days from the date of the written scope. After that, or if the scope changes, we quote again. Trademark clearance is not in any fee we quote; that goes to your own attorney.
What you may not do here
- Send automated submissions, scrape the forms or test them with junk. The honeypot fields exist for this and the log shows it.
- Use the forms or chat to harass anyone, or to send malware, links to it or unlawful material.
- Pretend to be someone else, or send a data request about a person who has not authorised you.
- Try to reach parts of the server that are not linked from public pages, or probe them for weaknesses.
- Use the forms to send offers to buy the domain repeatedly after the one-line reply saying it is not for sale.
Who owns the words, photographs and marks
The text, photographs, the Xavriqon name, the logo and its lettering, and the layout of this site belong to Xavriqon. You may quote a short passage with a link back. You may not copy pages wholesale, reuse the photographs or use the name or logo to suggest a connection that does not exist.
A letter you send stays yours. By sending it you allow us to store it and reply to it, nothing more. We will not publish it or quote it without asking.
What is provided as is
The site, the fit checker and everything published here are provided as is. We do not warrant that the site will be available at any given hour, that it is free of errors or that a direction will reach launch.
The fit checker computes dates from the rules it is given: three business days, skipping Saturday and Sunday, and the 45-day Texas data request window plus one 45-day extension. It does not know about public holidays and it is not legal advice. Nothing on this site is legal, trademark or financial advice. A naming assessment tells you how a name behaves when spoken, spelled and searched; whether you can register or defend it is a question for an attorney.
The limit of our liability
For use of the free site, the forms, the chat and the checker, our total liability to you is limited to US$100. For paid work under a written scope, it is limited to the fee you paid for that job. We are not liable for indirect or consequential loss, such as lost profit or a launch that slips because you waited on a reply instead of acting.
None of this limits liability for fraud, for gross negligence, or for anything Texas law does not allow to be limited.
What we guarantee, and what we will not pretend to
These are the things we stand behind without conditions:
- Every letter that passes the spam filter is read by a person.
- A data request is answered within 7 days, well inside the 45 days Texas law allows.
- The domain offer reply is always the same: it is not for sale. No haggling, no "make us an offer".
- A paid naming assessment is delivered by the date written in the scope you accepted. If we cannot make that date, we say so in writing before it passes, and what happens to the fee is settled under the terms of that scope.
What we do not guarantee: a reply to letters about Parked or In study directions; the three-business-day reply window, which is a working rule; any launch date for anything; and that a name we assess will clear a trademark search. We say this plainly because the most common complaint about holding pages is a promise nobody kept.
When we refuse or withdraw access
We may block an IP address, ignore a sender or close a chat thread when section 05 is broken, without notice. We may also take the site down, change it or end a direction at any time; a direction ending is noted on its own page. Paid work already accepted in writing is finished or refunded for the unfinished part.
Governing law and where disputes go
These terms run under the law of Texas, United States. A dispute is heard in the courts of Austin. If you are a consumer in another state or country with rights that cannot be signed away, those rights still apply.
Before filing anything, write to us. Most disagreements over a short engagement end in one exchange of letters.
How a change is announced
A change goes up on this page with a new version number and date in the header. The version you accepted applies to anything you sent before the change. A written scope you already signed is not altered by a later version of these terms.
